Terms of service

The rules for using Hank.

Agreeing to these terms

By creating a Hank account, installing the Hank app, or using the service in any way, you agree to these terms. If you don’t agree, don’t use Hank. If you’re using Hank on behalf of a business, you’re saying you have authority to bind that business.

“Hank,” “we,” and “us” mean Schwartz Software Group LLC, a New York limited liability company. “You” means the person or business using Hank.

What Hank does

Hank is an AI answering service for trade shops. We assign you a phone number (or port your existing one), answer calls you miss, text customers back on your behalf, and surface those conversations in the Hank iOS app for you to take over or review.

Hank’s replies are generated by AI. They’re designed to be accurate, but they’re not perfect — you’re responsible for what gets sent from your number. We give you tools (takeover, pause, review) to stay in control.

Your account

You need an account to use Hank. Keep your login secure. You’re responsible for everything that happens under your account. Tell us right away if you think it’s been compromised: support@itshank.com.

One account per business. Don’t share logins. Don’t let someone else use your account to run their business through it.

Pricing & billing

Hank is paid. You agree to the pricing shown when you sign up. We bill monthly through Stripe. Subscriptions auto-renew until you cancel.

You can cancel anytime from the app. Cancellation stops the next renewal — we don’t refund the current period unless we’re obviously at fault. If a charge is wrong, email us and we’ll fix it.

If your payment fails, we’ll try again a few times. If it keeps failing, we’ll pause your service. We don’t delete your data immediately — you have 90 days to come back and pay before we delete.

We can change prices with 30 days’ notice for existing customers. If you don’t like the new price, cancel before it takes effect.

Acceptable use

Don’t use Hank to:

  • Send spam, marketing blasts, or unsolicited promotional texts.
  • Impersonate someone you’re not (e.g., pretending to be a different business).
  • Violate TCPA, CAN-SPAM, state telemarketing laws, or carrier rules.
  • Harass, threaten, or defraud anyone.
  • Run prohibited content (drugs, weapons, adult content, gambling, etc.) through SMS — carriers ban it and we have to too.
  • Reverse-engineer, scrape, or abuse the service.

If you do any of this, we can suspend or terminate your account immediately without refund.

Messaging program (SMS / RCS)

Hank operates a customer-service messaging program for the trade shops on our platform. Key details:

  • Program name: Hank Customer Service Messaging
  • How consumers opt in: by calling a participating shop, hearing the IVR prompt, and pressing 2 on their dialpad. That keypress is the explicit opt-in. No keypress = no messages.
  • Message frequency: variable. Messages are sent only in response to a consumer’s own inquiry. No marketing blasts, no scheduled outreach.
  • Cost: Hank does not charge consumers to text. Standard message and data rates from the consumer’s mobile carrier may apply.
  • Opt-out: consumers can reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, OPT-OUT) at any time. Replying HELP returns support contact information.
  • Carrier disclaimer: mobile carriers (T-Mobile, Verizon, AT&T, etc.) are not liable for delayed or undelivered messages.
  • Consent data: opt-in and consent records are used solely to operate the program and are not shared with third parties for their own marketing purposes.

AI disclaimer

Hank uses AI to compose replies. AI can be wrong. AI can hallucinate facts, get times mixed up, or say something off-brand. We do our best to keep it tight (system prompts, takeover banners, conservative defaults), but you are the final authority on what your business says.

Review conversations. Use takeover when accuracy matters. Don’t rely on Hank for emergencies, medical, legal, or safety-critical communication.

Your content

You own the content you put into Hank — your business info, your conversations, your customer data. You give us a license to use it strictly to operate the service for you (route calls, generate replies, store messages, bill you).

We don’t train AI models on your conversations. We don’t sell your data. Full details in the privacy policy.

Our content

The Hank app, website, brand, code, and design are ours. You get a limited, non-exclusive, non-transferable right to use them while your account is active. Don’t copy or resell them.

Third-party services

Hank runs on top of Twilio (SMS, voice, RCS), Anthropic (AI), Stripe (billing), and Firebase (storage). If those providers have outages or change their terms, it may affect Hank. We’ll do our best to route around problems but we don’t control them.

Termination

You can cancel anytime. We can terminate your account if you breach these terms, stop paying, or use Hank in a way that puts us or our infrastructure at risk. We’ll usually warn you first unless it’s urgent.

On termination, you lose access immediately. We retain your data for 90 days in case you come back, then we delete it (subject to legal retention).

Disclaimers

Hank is provided “as is.” We don’t guarantee it will be uninterrupted, error-free, or fit a particular purpose beyond what we describe on the site. To the maximum extent allowed by law, we disclaim all implied warranties.

Liability cap

To the maximum extent allowed by law, our total liability to you for any claim is limited to the greater of (a) the amount you paid Hank in the 12 months before the claim, or (b) $100. We are not liable for indirect, incidental, consequential, or punitive damages (lost profits, lost business, etc.).

Some states don’t allow these limits. If yours doesn’t, the limits apply to the maximum extent permitted.

Indemnification

If someone sues us because of how you used Hank (e.g., you spammed people, violated TCPA, infringed someone’s rights), you agree to cover our reasonable legal costs and any damages.

Governing law

These terms are governed by the laws of the State of New York, without regard to conflict of laws. Disputes go to the state or federal courts located in New York, and you and we agree to that jurisdiction.

Changes

We may update these terms. If we make material changes, we’ll notify you (in-app or by email) at least 14 days before they take effect. Continued use after that means you accept the new terms.
